THE MIDWEST AFFORDABLE HOUSING MANAGEMENT ASSOCIATION (MAHMA) is a professional association representing owners and managers of affordable housing throughout Indiana, Illinois, Ohio, Michigan, Minnesota and Wisconsin.
We are a regional organization with grassroots support from local, regional and national affiliations. Through our liaison with THE NATIONAL AFFORDABLE HOUSING MANAGEMENT ASSOCIATION (NAHMA), our members benefit from the tremendous support and legislative work that is provided by the working partnership of the national HUD offices and other government, and community agencies. Weatherization Assistance Program for Low-Income Persons |

Update from NAHMA:
Today, the Department of Energy (DOE) published its final rule for the “Weatherization Assistance Program for Low-Income Persons” (Docket No. EEWAP0515). Last summer, HUD partnered with DOE in order to expand its weatherization program for low-income persons to the HUD affordable housing portfolio. As a result of this final rule, if a multi-unit building is identified as by HUD as part of an assisted or public housing program and included on a list published by DOE, that building will meet the income eligibility requirements and will satisfy certain procedural requirements of the program without the need for additional evaluation or verification.

Release From NHMC/NAA:
On January 25, 2010, the U.S. Department of Energy (DOE) issued final rules streamlining the Weatherization Assistance Program application process.
The NMHC/NAA-supported rule makes certain HUD-assisted and Low-Income Housing Tax Credit (LIHTC) properties automatically eligible without further evaluation or verification.
Prior to these new rules, which are effective as of February 24, apartment properties had to verify the income of every resident to apply for weatherization funds, even though HUD and the IRS were already collecting resident income verification data for subsidized properties.
The rule further provides that these properties automatically satisfy one or both of the other program eligibility requirements regarding prohibitions against rent increases and excessive enhancements to the property.
Since 2006, NMHC/NAA have urged the DOE and HUD to make these changes to application process. The new rules should allow our industry greater access to the $5 billion allocated to the program by last February's economic stimulus bill (P.L.111-5).

OHFA Board Approves More Than $53M for Property Restoration & Neighborhood Regeneration |
|
The Ohio Housing Finance Agency (OHFA) Board approved over $49 million of Tax Credit Exchange (TCE) and Tax Credit Assistance Program (TCAP) dollars created in the American Recovery and Reinvestment Act (ARRA) together with more than $4 million from OHFA's Housing Development Assistance Program (HDAP).
Funding will be used to support the development of 13 multifamily residential properties serving low- and moderate-income residents throughout the state.

EIV & You Brochure Notice Issued |

Notice, H 2010-02, Enterprise Income Verification (EIV) & You Brochure - Requirements for Distribution and Use, was issued on January 11, 2010. This Notice provides instructions to owners and management agents (O/As) on the distribution and use of the EIV & You brochure. It is important that O/As obtain a copy of this Notice and be familiar with the contents prior to January 31, 2010, when EIV becomes mandatory. Housing Trust Fund; Allocation Formula; Proposed Rule
Last month, HUD introduced a proposed rule for the formula for distributing the Housing Trust Fund (HTF) resources to the states, titled: "Housing Trust Fund; Allocation Formula; Proposed Rule" (December 4, 2009, Docket No. FR-5246-P-01). As you may recall, H.R. 3221 (P.L. 110-289), the Housing and Economic Recovery Act of 2008 (HERA), established the HTF to provide grants to states to increase and preserve the supply of rental housing for extremely low- and very low-income families, including homeless families, and to increase homeownership for extremely low- and very low-income families.

Regulatory Impact Analysis for the Housing Trust Fund
HUD's Office of Policy Development and Research has recently released a report titled "Regulatory Impact Analysis for the Housing Trust Fund," which discusses the regulatory impact of the HTF. This Analysis meets the requirements of Executive Order 12866 to prepare an impact analysis (for review by the Office of Management and Budget) of any regulation projected to have an annual economic impact of $100 million or more.

Use of the EIV system for Multifamily Housing Program users will become mandatory on January 31, 2010, the effective date of the "Refinement of Income and Rent Determination Requirements in Public and Assisted Housing Programs: Implementation of the Enterprise Income Verification System - Amendments; Final Rule" published in the Federal Register on December 29, 2009 (FR-5351-F-02).
Owners and management agents who do not have access to EIV must act now by taking the steps outlined below.
